Hongkong to receive and detain the deportee. Such a case does not seem to fall within the terms of Article 8å of the 1904 Order. Article 84 of the same Order, as enacted by Article 6 of the 1907 Order, which deals with the case of transhipment of at Hongkong, seems rather to suggest an authority from the Governor of Hongkong for the purpose of sending the deportee from Hongkong to the place of deportation. This, however, is

by no means clear, and if that is the intention of the article

it is not worded very happily. Of course, if a warrant from

the Governor to the master of the transhipping ship is not con- templated by article 84, such a warrant would not be protected

by section 8 of the Foreign Jurisdiction Act, 1890.

5. It may be that the ahore objections are not well

founded, and I should therefore be much obliged for the opinion of the British authorities in China upon them.

There are also two practical diffiqulties. One is,

that unless a passage had been booked in advance by the tranship -ping ship, it might happen upon the arrival of the deportes at

Hongkong, that no accommodation was available by the ship

referred to in the warrant of the Court. The other is that it

is very difficult for the master of a ship which carries only a Chinese crew to guard properly a deportes who may very wall

be of a violent and resourceful character, and the escape of a

deportes might render the ship liable to heavy penalties at a port of sall, besides being a failure of duty under the warrant, This was hy the agents of the 5.3. "Eastern" objected so stranu - ously to receive Bushby as prisoner.
